IN THE CONTEXT OF PROFESSIONAL COMPUTER SYSTEMS DESIGN CONSULTING SERVICES, ANY LIABILITY OF MTR BEEF GAS LLC FOR ERRORS OR OMISSIONS IN THE PERFORMANCE OF PROFESSIONAL SERVICES SHALL BE GOVERNED EXCLUSIVELY BY THE TERMS OF THE APPLICABLE WRITTEN SERVICES AGREEMENT BETWEEN THE PARTIES, WHICH MAY INCLUDE SEPARATE LIMITATIONS OF LIABILITY, INDEMNIFICATION OBLIGATIONS, AND INSURANCE REQUIREMENTS. 11. Indemnification

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Prior to initiating any formal legal action, the parties agree to attempt to resolve any dispute informally by contacting MTR BEEF GAS LLC at serve@mtrbeefgas.hair and engaging in good-faith negotiations for a period of at least thirty days. Such informal resolution efforts shall commence upon written notice from one party to the other describing the nature of the dispute and the relief sought. If the dispute cannot be resolved through informal negotiations, the parties agree to submit the dispute to mediation administered by a mutually agreed upon mediation service in the State of Utah before resorting to litigation.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the website or these Terms of Service must be filed within one year after such claim or cause of action arose or be forever barred. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms of Service.
